FOR
EXOTIC BIRD SOCIETY OF AMERICA’S
PHOTO/VIDEO CONTEST
( No purchase or payment necessary to enter or win )
By submitting your entry, you agree to be bound by
the following Contest Rules:
AGREEMENT TO OFFICIAL RULES: Participation in this Contest constitutes entrant's
full and unconditional agreement to and complete acceptance of these Official
Rules and the decisions of the Sponsor, which are final and binding. Winning a
prize is contingent upon fulfilling all requirements set forth herein and the
results of online voting. Contest Rules may change from time to time; therefore
contestants should read the rules before every submission. By your submission,
you are acknowledging your full acceptance of, and compliance with, the rules
at the time of your submission. Contest is void where prohibited or limited by
law.
ELIGIBILITY:
To enter, you must be at least 18 years of age and a U.S.
citizen or permanent legal resident of the United States. The Contest is
subject to all applicable federal, state, provincial and local laws and
regulations and is void in Puerto Rico and
where prohibited by law Contest is closed to the Contest organizer, their
family, and company staff.
ENTRANT’S ORIGINAL WORK: You (entrant) must only enter photos that YOU have
personally taken and own all rights for. Photos taken by someone else are not
allowed. All entries must be original works photographed and created solely by
the entrant and by entering this contest, you warrant
that entry is your own original work
COPYRIGHT: Copyrights of the image remains the property of the
contestant, but by entering you are granting a non-exclusive usage license
to sponsor for using any image submitted, whether chosen as a winner
or not. (see next item for license details) and grant the sponsor unlimited
non-exclusive rights to incorporate submitted image in works covered
under collective registered copyright of Sponsor. You agree to hold
us harmless from any visitors to this site making any unauthorized use
of your or videos.
IMAGE USE LICENSING: By entering this contest, entrants are giving permission
for their photographs or Videos to be displayed on www.birdphotocontest.org and related
websites for the purposes of online voting related to the submissions,
for display of winning entries, promotion or reporting of the contest
or any other sponsor use including image galleries, e-cards, banners,
software, slideshows, DVD, CD, multimedia presentation, or any other
method, in perpetuity and without restriction. By entering, entrant
agrees that they hereby grant www.birdphotocontest.org and its designees
a non-exclusive perpetual worldwide royalty-free image usage license
to submitted image, with Contest sponsor granted full (non-exclusive)
rights to edit, publish, and use or re-use submitted photograph(s) or
Video(s) in any way and in any media for trade, advertising, promotional,
and/or other purposes as Exotic bird Society of America, Inc. may
determine in its sole discretion without further consideration or compensation
to any entrant or winner.
MODEL PERMISSIONS & IMAGE ORIGINALITY: By submitting an entry, entrant acknowledges and
certifies that they have complete permission and legal authority of any and all
recognizable pets or persons appearing in the photograph or video to be able to grant to
Exotic bird Society of America, Inc.
the legal right to publish their photographic or video submission online and in other
formats as described in these rules, and hereby grants Exotic bird Society of America, Inc. such rights.
IMAGE CONTENT RESTRICTIONS: Entrant agrees that the Photo or video will not include
copyrighted or trademarked material belonging to a third party. Photos
or videos showing any such trademarks (brand names, signs, logos, etc)
or with copyrighted material belonging to a third party are not eligible
for Contest and such photos may be disqualified at the sole discretion
of sponsor without notice or further explanation. Photos or videos must
be of a nature appropriate for posting on a public website. Obscene,
provocative, mature matter or any otherwise potentially questionable
content will not be considered for Contest and Exotic bird Society of America, Inc. retains
the sole discretion as to what constitutes inappropriate content for
Contest participation and reserves the right to remove any image it
deems to violate image content restrictions without notice or further
explanation.
CREDITS: Winning
and other entries may be displayed with text overlay photographers
name/initials/state (ex. ©
Mary M., Florida )
or any variation deemed appropriate by sponsor. Such credits or format is not
guaranteed and may be changed throughout Contest or if images are used for
other purposes such as multimedia presentations.
HOW TO ENTER:
This is an ONLINE ENTRY ONLY photo and video contest, and DIGITAL IMAGES ONLY are allowed
and ONLY accepted via digital transfer (upload/email) as directed on and using the
official entry form. (No mail-in option is available.)
FRQUENCY / NUMBER OF ENTRIES: You may submit up to five (5) unique photos or videos per month, with
a month beginning on the 1st of the month and ending at midnight on
the last day of the given month. Contestants entering
more than five photos or videos per month will eliminate themselves
from the Contest for the month. You may submit
the SAME photo or video only ONCE and once your photo or video is accepted
in the Contest, you may not submit that same photo again; doing so may
disqualify your photos or videos from future Contest consideration. Any monthly
winners may continue to submit new photos for online placement and display,
but may not be a monthly winner more often than once in a 3 month period.
DIGITAL PHOTO AND VIDEO REQUIREMENTS: Digital
Images in .jpg / .jpeg format, between
640x480 to 800x600 pixels in size at 72 dpi, and a file size smaller than 2mb.
Image files may NOT contain any watermarks (copyrights, names, or text
overlays).
FILE FORMAT:
To be considered for this Contest, your
photo must be submitted in a DIGITAL form only and as a .jpg .JPEG format file
only. Other formats are not acceptable and will not be entered in contest.
Files should be saved as “high quality” .jpg files for best
results. Prints or slides are not accepted for entry into this Contest,
although Entrants may submit digital versions of any prints they scan into
digital format form from prints themselves, but Sponsor will not accept or scan
prints mailed in for entry.
IMAGE SIZE
SPECIFICATIONS: Images submitted should be between 640x480 to 800x600 pixels in size
(larger images will be resized; smaller ones cannot be enlarged and will
not be used if deemed by Sponsor too small to maintain quality. 72dpi is ideal
for screen display and all entries should be saved at 72dpi. Images may be
resized or re-sampled at Sponsors discretion as needed to fit their needs for
display purposes.
FILE SIZE: Images submitted should
not exceed 2mb, with 200k or less being ideal for quick onscreen judging.

MONTHLY CONTEST ENTRY PERIOD: This MONTHLY Contest begins at 12:00:01 a.m.
Eastern Time ("EST") on the first day of each month and runs on a MONTHLY basis with
each contest period ending 11:59:59 p.m. EST on the last day of each month (the
"Entry Period"). Entries submitted after a given months Entry Period
will be entered into the next months Contest. Potential winners will be
selected on or about the 7th of each month following the Entry
Period (the "Selection Date") with
JUDGING / VOTING: Each month, one winner will be selected from among those submissions
fully adhering to these Contest Rules and Winner will be chosen based
upon the highest number of total unique votes cast online via the website
voting system as determined by the sponsor.
The decision of the Sponsor will be final. Each individual website
visitor may only vote for a photo one (1) time and additional votes
from same visitor will not be counted. Use of any automated system,
program, script, or macro to submit entries or vote is prohibited and
will result in disqualification. The Sponsor reserves the right in its
sole discretion to disqualify any individual it finds to be tampering
with the entry process, the operation of the Contest, to be acting in
violation of these Official Rules, or in a disruptive manner
PRIZES:
MONTHLY FIRST PRIZE –
AWARDED TO ONE (1) WINNER MONTHLY: One
Monthly First Prize Winner shall receive the monthly prize as described on the
MONTHLY PRIZE PAGE. Monthly prize will vary, and will consist of the single
product or group of products as described on the MONTHLY PRIZE PAGE only. Since
prizes vary on a monthly basis, the ARV (approximate retail value) will
depend on prize for any given month.
MONTHLY HONORABLE MENTION PRIZE(S) –
MAY BE AWARDED MONTHLY at Sponsors
sole discretion to specially selected entries not chosen as First Prize Winner and
in a quantity decided upon by the Sponsor with no guarantee of any Honorable
Mentions being awarded at all in any given monthly contest. Any monthly
honorable mention winners will receive a digital-based prize only (wallpaper,
icon, software program, or similar) that may only be downloaded by winner as
directed in the notification email and will have an ARV or $.99-$19.95 each
depending on which prize is being awarded.
ANNUAL GRAND PRIZE – AWARDED TO ONE WINNER AT END
OF EACH YEAR: Sponsor will
be hosting monthly (Entry Period) contests throughout the year and leading
up to the end of the year when the First Prize winner of each Monthly
Contest will be entered into a separate Contest for the "Grand
Prize" winner. The Grand Prize winner will be selected from the
First Prize Winners of all the contests and Grand Prize Winner will
be determined by a panel of judges chosen by the Sponsor, including a professional pet magazine photographer, without regard
to any previous monthly vote counts.. GRAND PRIZE will vary each year, and will consist of the
single product or group of products as described on the GRAND PRIZE
PAGE only where details will be given on exact prize content and ARV (approximate retail value) of Grand
Prize. Grand Prize will be awarded within the first two (2) weeks following
the beginning of a new calendar year and Winner will be notified by
postal mail or email. Decision of Sponsor is final.
All Prizes are
not transferable or refundable and must be accepted as awarded. No cash or
other substitution may be made, except at the sole discretion of Sponsor, who reserves
the right to substitute the Prizes with another prize of equal or greater value
if the Prizes are not available for any reason as determined by the Sponsor in
its sole discretion. Contest Winner is responsible for any taxes (local, state,
or federal) or fees associated with receipt or use of the Prize. Prizes will
only be shipped (when appropriate) to the street address given by entrant on
official entry form, and sponsor in not responsible for late, lost, misdirected
or undeliverable shipments. Details on how to access Download or Online prizes
will be detailed in a winners email sent to Entrants email on entry form.
WINNER NOTIFICATION / PRIZE DELIVERY: Contests results posted online at BIRDPHOTOCONTEST.ORG and
individual winner(s) notified by email and/or postal mail and have 7 days to
respond to notification via e-mail. While every reasonable effort will be made
to contact each winner, BIRDPHOTOCONTEST.ORG
is not responsible should prizes go unclaimed and after 30 days without contact
from winner, prize is forfeited and will not be awarded for that monthly
contest period.
RIGHT OF PUBLICITY: Except where prohibited, participation in this contest constitutes
Entrant’s consent to the Sponsors' use of winner's name, likeness and
state of residence for the purpose of advertising, trade or promotion, in any
media throughout the world, without further payment or consideration.
PRIVACY: In
addition to the use rights for image(s) submitted, by participating in the
Contest, entrant authorizes Sponsor to collect, use, process, transfer and
store any and all personal data provided by entrant on entry form, including
and without limitation, personal data that the Sponsor deems necessary for
purposes of administration of the Contest. All information submitted to the
Sponsor as part of this Contest will be treated in accordance with the
Sponsor's privacy statement, available at BIRDPHOTOCONTEST.ORG
PRIVACY PAGE
Personal information will be used to: (a) contact potential
winners; (b) if an entrant selects to receive additional information from the
Sponsor's on the entry form, to send additional information to that entrant;
and (c) to promote or credit entrants participation in Contest
SPONSOR:
The Contest is sponsored by EXOTIC BIRD
SOCIETY OF AMERICA, INC. – 9724 Fifth Ave Orlando, FL (the
"Sponsor").
GENERAL CONDITIONS: Sponsor is not responsible for late, lost, illegible, incomplete or
misdirected entries; interrupted or unavailable network servers; or other
connection miscommunications, failed phone or computer or telephone
transmissions, or technical failure, jumbled, scrambled or misdirected
transmissions or other error of any kind whether human, mechanical or
electronic that may affect the Contest entry process. In case events beyond the
reasonable control of the Sponsor that may cause the Contest to be disrupted or
corrupted, the Sponsor may, in its sole discretion, either: (a) suspend the
Contest to address such impairment and then resume the Contest in a manner
which best conforms to the intent of these Official Rules; or (b) award the
prize from among the eligible entries received up to the time of the
impairment. In the event an insufficient number of entries are received,
Sponsor reserves the right to cancel the Contest and shall be under no
obligation to award the prizes. Sponsor reserves the right to end Contest at
the end of any Contest period without advanced notice or notification.
Any attempt by
any person to undermine the legitimate operation of the Contest may be a
violation of criminal and civil law, and, should such an attempt be made, the
Sponsor reserves the right to seek damages from any such person to the fullest
extent permitted by law. The Sponsor's failure to enforce any term of these
Official Rules shall not constitute a waiver of that provision.
RELEASE AND LIMITATION OF LIABILITY: By participating in the Contest, entrants agree to
release and hold harmless the Sponsor, its officers, directors, employees, and
agents (the "Released Parties") from and against any claim or cause
of action arising out of participation in the Contest, or receipt or use of any
prize, including, but not limited to: (a) unauthorized human intervention in
the Contest; (b) technical errors related to computers, servers, providers, or
telephone or network lines; (c) printing errors; (d) lost, late, postage-due,
misdirected, or undeliverable mail; (e) errors in the administration of the
Contest or the processing of entries; or (f) injury or damage to persons or
property which may be caused, directly or indirectly, in whole or in part, from
entrant's participation in the Contest or acceptance, receipt, use, or misuse
of any prize; and (g) any claims based on publicity rights, copyright/trademark
infringement, intellectual property rights, defamation or invasion of privacy
and merchandise delivery. Entrant further agrees that in any cause of action,
the Released Parties' liability will be limited to the cost of entering and
participating in the Contest, and in no event shall the Released Parties be
liable for attorney's fees. Entrant waives the right to claim any damages
whatsoever, including, but not limited to, punitive, incidental, consequential,
direct, or indirect damages. Sponsor is not responsible if any prize cannot be
awarded due to cancellations, delays or interruptions due to acts of God, acts
of war, natural disasters, weather or acts of terrorism.
DISPUTES: Except
where prohibited, entrant agrees that any and all disputes, claims, and causes
of action arising out of, or connected with, the Contest or any prize awarded
shall be resolved individually, without resort to any form of class action, and
exclusively by the appropriate court located in the State of Florida. All issues and questions concerning
the construction, validity, interpretation and enforceability of these Official
Rules, entrant's rights and obligations, or the rights and obligations of the
Released Parties in connection with the Contest, shall be governed by, and
construed in accordance with, the laws of the State of Florida.

Ave Orlando, FL. All requests must be received by The first of each month starting January, 2007 and going until October
31, 2007.
